The following horror story is like so many in the world where a sexually abusive father fights tooth and nail to get his victims back.  The children are trying to heal and yet their father continues to try gain access to his victims unsupervised.  A mother made a promise to her children that they would be safe forever…mothers always keep their promises.

I am a devoted, loving and protective Canadian mom of 4 stunning children. My name is Cara and I am being held captive in a country that claims liberty and justice for all and yet this is not the case here in America and globally.  Our captor is our abuser, the ransom, their childhood and our freedom to live a life without abuse.  I am being forced to file paperwork that our abuser refused to file for me as it was part of his abuse arsenal over me during our marriage to keep me in my place.  I have no legal rights unless I can afford to pay for them and more importantly, as survivors of domestic violence and our boys, child abuse, we are being re victimized by the very systems that took an oath to serve and protect, give due process and serve the best interest of the child.

I came to America engaged to a man who gave me his word he’d take care of me.  We have 2 boys together.  I left a marriage I thought would last the rest of my life, well, that was until I realized we were in danger.  In Nov 2004 after careful planning I saw the window of opportunity to get myself and our 2 boys out safely.  In the middle of the night, a friend came to pick us up and drive us to our safe place.  A woman’s shelter in PA.  I tucked my then 10mos and 22mos old boys into our bed and for the first time since coming to America, we slept in peace.  No more did I fear waking up to a gun pointing at my head, no longer did I hear his words of how he was going to kill me and bury me all over the States, no more did I hear him spew his venom at our toddlers.  Finally, we were safe…or so I thought.  Little did I know what would be in store for us over the course of the upcoming yrs.  We were at the gates of Hell and didn’t even know it…until now.

I tried to be the friendly parent, I tried to co-parent, I just wanted to know our safety would be priority to family courts.  Sadly, this was not the case and still, abuse lurks in corners.  Our abuser used the family courts and his attorney as extensions of his abuse.  We had Protection from Abuse (PFA’s) orders issued against him, we had witnesses and documentation to substantiate our claims.  Mandated reporters called CPS (Child Protective Services) a total of 10-12 times only one report was treated with the respect and safety the children deserved which resulted in 2 supported investigations of sexual abuse against their father; our abuser.  After 6 years of torment, taunting and judicial abuse the childrens cries were heard.  It no longer mattered to me that the Courts belittled and outright dismissed the domestic violence, all that mattered now was our 2 boys were BELIEVED.  After 5&6 yrs of being their primary caretaker, Dec 2008 they were raped from my custody and placed with our abuser who at this time was now a 4 State drive away.  Why the term rape, because I have been raped and the tearing away of your children to our abuser runs parallel to being raped by your attacker.  The children testified to the abuse and the Judge dismissed their testimony, the Judge dismissed the treating psychologist would could substantiate the child’s fears and reactive behaviour.  The only thing the Judicial system saw was an immigrant mother who was obviously making allegations to gain custody.  Furthest from the truth. 70% of Batters gain custody when they file for it, 1.3% of abuse allegations are false, I’m not that 1.3%  I was sadly awarded visitation and our abuser controlled even that.  Then in March of 2009 without notice not more than 24 hrs of having the boys home, they both disclosed sexual abuse against their father.  A forensic interview was completed in MA (our home State) and sent to PA the State of jurisdiction.  The children were taken into protective custody and I was only afforded 3 phone calls in a 48 day period while our abuser was allowed continued supervised visitation once a week.

The children were so brave as they continued to disclose and sadly act out.  The CPS investigator completed her findings and presented it to the Judge with the recommendation that the children be returned to my custody and that the children not remain in foster care.  Our abuser testified that he’d rather see them in foster care than with me their mother. 3 days later the Honorable Judge Stein order the children back to me this time awarding me sole custody of our boys and giving our abuser supervised visits though a accredited centre that would ensure the children’s safety.

No sooner did this happen that our abuser filed for an appeal against the indicated reports of sexual abuse against our 2 sons.  In Dec 2009 with less than 24hrs notice to appear in court 4 States away, the children were confronted by their abuser prior to testifying.  The very man who had told the boys that if they told about “daddy’s secret” they could all go to jail, or even be killed. (nothing different from threats he had made to me during our marriage.)  The boys asked me if they were going back to foster care and I had told them no, they asked why they were there and I told them because the Judge wants to hear what they told us and the investigator about the things they said about their dad.  They also wanted confirmation that we’d then go home and I said yes, then we’d go straight home.  Upon exiting, our youngest did state that he told a lie about me, when asked why, he sadly said he “was afraid that daddy’s lawyer would get mad” I told him not to worry, it would be okay.

May 15, 2010 I get notice in the mail via the attorney for CPS informing me that our abuser’s appeal before the Administrative Law Judge was granted and ordered CPS to expunge his record as ”they did not convince me that they were telling the truth” He went further to state that “their mother influenced their testimony” and the “Appellant denied that he sexually abused the subject children.  Appellant’s testimony was credible”

With this feather in his hat, our abuser has now served me with more litigation papers, this time seeking sole custody and to have my parental rights suspended pending a custody hearing.  I have brought this to the attention of the boys treating specialists and they were not a bit surprised as they see this happen all to often to young children who have suffered child abuse and placed on an adult platform like testifying in court especially in the known presence of their abuser.  So here we go back down the Rabbit Hole of a broken and failing family court system that is not protecting our children but rather trafficking them to the money whores of the CRT.   Sadly, this is not just in America as I have found out and worse yet, I am not alone.  This is a global crisis that is even taking place in my own home country of Canada.

Is no child safe anymore? Aren’t they WORTH SAVING?

What happens when a citizen of the US vacations in Mexico and something bad happens, something really bad, something violent, or worse, murder? We all think we have some grasp of how our own criminal justice system works; the bad guys are caught, charged, go to trial, are convicted and sentenced. Well, maybe in an ideal world.

In as much as we feel the justice system in the United States needs to be overhauled, changes in plea deals and light sentences, among other things, how many of us can truthfully say we know how the criminal justice system works in other countries? We love to vacation in Europe, Asia and Central and South America, many buying vacation property and retirement homes in third world countries, but what happens when trouble starts?

In April, Bruce and Monica Beresford-Redman agreed to take a trip to Cancun to help repair their marriage, which, by all accounts, was quite troubled. Many around Monica, including her family, didn’t feel that Bruce was "sincere" he was up to something and acting strange. Monica’s family warned her not to take the trip. Two young toddlers, 3 and 5 were vacationing with their parents while the couple embarked on, what Monica had hoped would be, a second chance; a second honeymoon with her husband, the producer for the hit tv show, "Survivor."

At what point did trouble start? In my opinion, it was when he began his premeditated plan, likely with some help, to elimate his wife and mother of his children in paradise in a foreign country. Pretty clever if you ask me.

What we do know for certain is the couple had serious problems. He was having an affair, in love with another woman and Monica wanted a divorce. This sick cowardly lion was not going to go quietly into the night. As an abuser will do when they are anrgy, or someone else other than them is attempting to call the shots to end a relationship, they look for a way to erase them from their lives. And, in my opinion, you can take it to the bank, that is exactly what happend.

Bruce Beresford-Redman reported his wife, Monica, missing after a night of arguing, as reported by others staying at the same hotel. Two days later her nude, beaten and strangled body was found in a sewer pipe near the resort where they were staying. When reporting her missing, it was noted by authorities that he had scratches and bruises on his body,was soon named a suspect and told not to leave Mexico until the evidence was gathered and investigated.

It was soon reported by E!Online that Beresford-Redman was "huddling with Eduardo Amerena, the noted criminal lawyer who successfully defended Duane "Dog" Chapman back in 2007, plotting a counterattack in the increasingly likely chance he is formally accused of slaying wife Monica and stuffing her body into a sewer." It was stated that he was going to say that Monica had been cheating on him, not he cheating on her! Oh yea, the old "blame the victim" routine! I guess he would be more believable stating that she was the "cheater" because she is no longer here to defend herself or to provide evidence to the contrary. Sounds very familar. It reminds us of the Stacy Peterson case. Who, by the way, like so many innocent lives, are not here any longer because they have also been elimiated.

Bruce Beresford-Redman was ordered to stay in Mexico, not charged with any crime, nor incarcerated. In the meantime, back in the USA, the fate of he and Monica’s children was decided. Against the wishes of her sisters and family, the children were awarded to their paternal grandparents, although temporary, they are filing for permanent custody.

To add another twist to the story, around May 20, Bruce Beresford-Redman was suddenly nowhere to be found! Mexican authorities had tried to contact him and were unable to reach him. Low and behold, he shows up back home in California just in time to have another one of his reality tv shows, Shedding for the Wedding, picked up by the CW network. Can we start boycotting the CW Network, please? We should all be outraged that any network in the United States would hire a man whom again, in my expert opinion, murdered his wife. If you go here you can leave an outage comment to the folks at the CW Network. Afterall, the CW Network are only fueling the fire, making a statement to society that "Intimate Partner Violence" and murder is acceptable.

Although he was ordered to give up his passport, Bruce was free to travel around Mexico. Free to find a way to get back over the border? Afterall, hundreds of illegals do it every day, undetected, or with authorities looking the other way! According to Mexican authorities, Beresford-Redman is the only suspect in his wife Monica’s brutal murder, and, now he has fled their country, the country which has jurisdiction over this crime. What will they do about it? Absoltely nothing and this piece of human garbageknows it.

So where is the justice, and what can the sisters and family of Monica Beresford-Redman do now? According to Private Investigators, Vito Colucci and Al Dressler, as stated on The Susan Murphy Milano Show, agree the family need to keep the public informed, they need to garner media attention and they need to keep the heat up by offering a reward, hiring a private investigator, or working within our system to insure that Monica’s murder does not turn into a cold case sitting in the dusty file cabinet in a Mexican police department.

One thing that may have saved the hundreds of thousands of dollars that will go into finally arresting and convicting the alleged murderer in this case is, if Monica, and others in known violent relationships, had taken the time to complete an Evidentiary Abuse Affidavit. Had this been done, the person who murdered Monica Beresford-Redman would most likely be sitting in jail.

If you, as a reader, are not aware of what an Evidentiary Abuse Affidavit is, it is a formal signed and notarized series of documents, along with video testimony, that can be used in a court of law if someone in a violent relationship is either missing or murdered. It can bypass all hearsay laws because it’s done in the "potential" victim’s own voice, own words and used like a will in the event that something happens.

Monica Beresford-Redmond traveled alive and well to another country and she returned because of a husband’s rage, in a body bag!

As we go about our daily lives, remember there are many "Monicas" out there right now who may be successful professional people, or down and out having a hard time, but one thing they have in common is violence within their homes. Follow the "Battle Cry"and extend your strength and your voice to help stop family violence.

    Another woman vanishes. This time the young mother of 2 children, ages 3 and 5, while walking to the mailbox in front of her parents home, still in her pajamas, is abducted.

    Venus Stewart has been missing since the morning of April 26, 2010. If you have learned anything from this site it is that I do not jump to conclusions. There are many cases of missing women and those found murdered that you do not see written about here because of various information I am unable to obtain about the case at the time. And sticking my neck out without the facts or restricted information is not healthy to the victims nor their families. But, bringing their case,s whenever possible, to the public’s attention and those who are in a relationship with an abusive person is the very least we can each do in hopes of preventing another tragedy.

    My work and expertise is based solely on 20 years with these cases of intimate partner violence, police officer abuse within the home, stalking, domestic violence and homicide.

    The case of missing Venus Stewart has many scratching their heads, with the exception of law enforcement and few others, myself included. The estranged husband was in another state and by car he would have had to drive 13 hours there (maybe he rented a car or borrowed one) and 13 hours back by the time police questioned him after Venus was abducted.

    Lets get out my note book on this case-

    Fact: the couple was going through a divorce;

    Fact: the couple was going through a major custody battle;

    Fact: Venus moved out of the marital residence in Virgina and into her parents home in Michigan;

    Fact: The couple had 2 children;

    Fact: Vensus Stewart had obtained numerous police reports;

    Fact: Vensus Stewart had obtained a minimum of 2 orders of protection from a judge;

    Fact: She told friends and family she was in fear for her life from this man;

    Fact: According to Venus and in court orders of protection she informed the courts her life was in danger.

    It is possible that someone was hired by the estranged husband the day Vensus was abducted. This reminds me of another recent case where the person of interest was in another location, a casino, gambling, at the time of the murders. Allegedly, a month before the shooting, Johnny Borizov hired his best friend, Jacob Nodarse to kill Angela and her parents. The evening of the shooting, Borizov was at a Joliet casino, captured on casino video, which he could conveniently claim as an air-tight alibi. According to sealed DuPage County court documents, Angela and Borizov had been scheduled to appear at a hearing a week after the killings. To read the case go here.

    Police are looking for a man, in the Venus Stewart disappearance, who people in the rural town saw hanging around the day before and thought it was suspicious. And police have issued a sketch of the man. Could this person have been hired by the estranged husband to help the day Venus was abducted? At this point, no one seems to know that answer.

    Now, if I am an angry abuser, not wanting the person with whom I am in a realtionship with to leave, and I have a violent temper, I am going to boil over like hot liquid on a stove. And, as an abuser, I have a lot of time to think out a plan of action. I am going to threaten the person where no one else can hear me. I will make a victim’s life unbearable in mediation meetings with mental health evaluators, while sitting dressed neatly and showing the world what a wonderful person I am. The moment the session is over I will shoot those looks of "now you did it" and "you are going to pay for this." Next, as custody is being determined, as an abuser I am outraged and say to myself, "she is not getting away with this alive."

    I then, as the abuser, figure out where to get that "handbook" available to members only in an e-book format that the recently formed "secret society of abusers" are all reading titled, "How to Get Away With the Ultimate Murder," author unknown.

    For some abusers, in my expert opinion, the "handbook" has worked in cases where the victim has vanished without a trace. There must be a chapter in the "handbook" on how to correctly lawyer up, as you will notice each "person of interest" no longer cooperates with authorities, often hiring a fairly skilled defense attorney, almost immediately. Thelegal hired gun acts as the shield or the mouth piece for the only person, once again in my expert opinion, behind the vanishing act of their loved one.

    Isn’t it rather strange that the victim is often the mother of their children, estranged wife or former girlfriend. And, more often than not, they are going thru a divorce or custody battle. And, yes, I need to mention that a person is innocent until proven guilty.

    Every single one of these cases has a common theme, the person has been erased from the planet. And a common theme does not make one guilty of the crime. But, it is highly unusual that the person with whom the relationship has ended does not have a motive. The facts, although circumstantial, do carry a lot of weight, but, often not enough for a grand jury indictment unless you have a body.

    So, I offer the following suggestions to law enforcement in this case where the "handbook" has obviously been downloaded:

  • First obtain a search warrant for all computers both business, personal, close friends and perhaps those of a relative, too.

  • Gas receipts, credit cards used within that time period must be gathered.

  • Unusual purchases at hardware and drugstores.

  • Where was the person 72 hours prior to the abduction? Were they at work? Did they call in sick?

  • Bank withdrawals within a two week period prior to her being taken.

  • Cell phone activity needs to be captured between the time of the abduction and the following 36 hours after the abduction.

      "I think that many women who’ve had an abusive spouse in their past may somewhat identify with Venus. She left her abuser, did what was RIGHT, and yet she’s currently missing and her abuser is the only named person of interest in the case.

      I give Venus kudos for, against all odds, leaving her abuser and getting her children out of that environment. There is no telling what her poor daughters have witnessed in the past. Worse, it can’t be as awful as what they’re experiencing now and will in the future…everything that we know about spousal abuse has come to fruition in this case. And as a result, these two girls will probably grow up motherless, but at least knowing that their mother mustered the courage to get them out of an abusive situation, even though it cost her life."

      When a mother’s bitter custody battle ends with the death of her child, something has gone terribly wrong with the system.

      Wyatt Garcia was born in April 2009. Nine months later, he was shot and killed by his father, who then turned the gun on himself.

      It might have turned out differently—if a family court judge had listened to Wyatt’s mother.

      Stephen Garcia, 25, a Pinon Hills, California contractor, had been allowed unsupervised visits with his son only a few days earlier by San Bernardino County Superior Judge Robert Lemkau, who was adjudicating a bitter custody battle between Garcia and the boy’s mother, Katie Tagle. The judge had refused to take seriously her repeated warnings of her ex-boyfriend’s violent and abusive behavior.

      Shortly after Wyatt was born, she left Garcia after he hit her so hard during an argument about his video-game addiction that “he knocked me out” Tagle said. After she moved home to her parents, her ex-boyfriend began harassing her and her family when he learned she was dating again, and he filed a motion for custody of little Wyatt. In turn she filed three motions for an order of protection against Garcia, which were ignored: in the last motion she charged that he had threatened to kill her and their baby.

      Judge Lemkau, however, chose to believe her former boyfriend’s denials rather than the evidence she supplied of Garcia’s threats―including e-mails, text messages and voice messages. Although no extenuating circumstances were raised in court transcripts of the case, the judge simply accused Tagle of lying, and ordered that she turn Wyatt over to his father—with fatal results.

      Tagle, 23, believes the odds against her and Wyatt were stacked the moment her case entered the emotional, chaotic world of the family court system.

      “I was treated like a criminal, like a complaining woman,” she says.

      The story of baby Wyatt Garcia is, sadly, not unusual.

      In the nine months between June 2009 and April 2010, 75 children have been killed by fathers involved in volatile custody battles with their former partners, according to the Center for Judicial Excellence, a court advocacy organization which has been tracking news articles of such deaths around the U.S. Based in San Rafael, California, the Center focuses on strengthening court integrity as well as improving public accountability of the judiciary.

      Some recent examples from the dockets of Family Courts around the country:

          * Teigan Peters Brown (3 years old), shot to death by his father during a court-ordered visit. (Arizona June 2009)

          * Bekm Bacon (8 months), killed by father, who then killed himself during overnight visitation. (Idaho Feb 2010)

          * Janiyah Nicole Hale (1 year), father is charged with her death during an overnight visitation. He is a registered sex offender. (Alabama July 2009)

      How did a system set up to protect families and children allow this to happen?

      An investigation by The Crime Report shows such tragedies are the consequences of family court procedures that allow abusive spouses to manipulate the system and leave at-risk children at the mercy of prolonged, expensive court battles over custody. These battles end all too often with a parent forced to share unsupervised custody with an abusive spouse.

      The problems have been complicated by systemic flaws in the nation’s family courts that have gone unaddressed far too long.

      A Broken System

      Lawyers, judges, psychologists and representatives of women’s groups interviewed by The Crime Report describe a broken family court system that is already burdened with a heavy caseload and too few judges—many of whom are forced to rotate between cases—and in which serious criminal allegations of domestic or sexual abuse are routinely ignored. The crushing financial costs of pursuing long custody battles is an additional burden on indigent mothers, who get little or no legal support. The odds are particularly stacked against children at risk when the court battle revolves over “he said, she said” arguments.

      The system has particularly failed parents―usually mothers―whose efforts to protect their children collide with an approach to custody issues that is based on narrow legal concepts of balance and fair treatment rather than psychological or medical evidence. “Courts assume mothers are orchestrating misinformation, instead of trying to protect their children,” said Kathleen Russell, director of the Center for Judicial Excellence.

      The idea of family courts or dockets began with the best of intentions. Established in the early nineteenth century, they were designed to protect the equitable rights of both parents and children and protect the family. Too often, however, that creates a built-in conflict. Judges, as in the case of Katie Tagle, adopt a skeptical attitude towards abuse charges, which most often come from the mother, on the grounds that it is hard to distinguish fact from fiction in arguments between quarreling parents.

      “The problem is that family court is not set up to protect children,” says Joyanna Silberg, PhD,Executive Vice President of the Leadership Council. “It is set up with the intent of equitable division for families. And this presents an overwhelming paradigm: how can you equitably divide a child?”

      And while the deaths of children are the public face of family court tragedies, the daily reality is that thousands of parents are trapped in prolonged court battles where they either lose their children to their alleged abuser, or are forced to share unsupervised custody.

      Advocacy groups interviewed for this story reported receiving between 450 and 1,000 requests for help in contested custody battles this year. The National Network to End Domestic Violence, a prominent national not-for-profit, says it is the biggest problem they are now facing. And the Leadership Council on Child Abuse & Interpersonal Violence, an independent scientific organization, estimates that each year more than 58,000 children are ordered by family courts into unsupervised contact with physically or sexually abusive parents following divorce in the United States

      Experts say abusers use the court system to exercise control over their former partner’s lives, manipulating the players and risking the safety and well being of the children’s lives the courts are sworn to protect.

      “Family courts are trained to look for cooperative behavior,” says Rob (Roberta) Valente, general counsel for the National Network to End Domestic Violence, which is based in Washington D.C. “When someone raises an abuse allegation, the court sees it as uncooperative behavior. The result, advocates say, is that the abuser is able to manipulate the court, while a child’s safety and well-being is placed at risk. Many judges are likely to view abuse complaints as a tactic to win custody battles. What the courts have failed to take into account but research has clearly shown time and time again, is that most of the cases that make it to trial in family court are high-risk abuse cases.

      Compounding the problem is that judges, attorneys and custody evaluators have little or no training in detecting signs of abuse.

      Just 20 per cent of the almost one million divorces and separations registered every year in the U.S. actually land in court. Most are settled in the pre-trial phase, according to Prof. Janet Johnston of San Jose State University, in research studies written for the journal, The Family Court Review.

      But of the few who make it to a judge, over 75 percent of these cases are victims of some form of domestic or sexual abuse, according to a 1995 paper by Prof. Peter Jaffe of the University of Western Ontario, who studies children and violence in U.S. and Canadian court systems.


      He Said, She said

      Today’s family courts have also been affected by the rise of the Fathers Rights movement. During the 1950s, family courts almost exclusively awarded custody to mothers. But complaints by fathers that their rights were ignored in custody battles led to a shift in the 1970s to awarding shared custody, on the grounds that it was in the best interest of the child to maintain a relationship with both parents.

      Nevertheless, only a small percentage of high-conflict cases require judges to act as conciliators between parties locked in otherwise endless litigation. The majority involve mothers and children that are suffering from serious sexual or domestic abuse.

      The National Father Resource Center disputes this, claiming that its member organizations report that 80 percent of mothers’ abuse allegations are false. Although Canadian research from the University of Toronto studying false allegations in U.S. and Canadian custody cases has found that between one and two percent of mothers make false allegations, the fathers’ rights argument has had a powerful impact. As shown by the Tagle case, courts don’t want to hear the mothers’ allegations.

      “Historically, allegations of abuse and incest are [met] with a great deal of suspicion, and there is a tremendous resistance to hearing these types of allegations,” said Eileen King, director of Justice for Children, a national non-profit that works to protect children involved in contested custody cases.

      Such resistance has already cost Deborah Hicks, 46, a former New York City television editor, six years of pain. In 2003, she filed for sole custody of her son, then three years old, when he came home from a visit to his father with suspicious signs of sexual abuse. There was reason to be worried. Her ex-partner had already been convicted of molesting a two-year old boy in Florida for which he served eight years in prison, and he was a registered sex offender in New York City. Despite her ex-boyfriend’s record, the judges who heard the case (there have been two), decided they had to give a fair hearing to his denials.

      She has already spent almost $100,000 on the case, with no end in sight. Nevertheless, she still shares custody with her ex, and says, “I am not about to give up on my child.”

      Even for those mothers who can afford it, the battle can take a psychological toll. Even when the evidence of risk to their children seems impossible to deny, the family court system that has proven incapable of treating these high-conflict cases with the serious attention and professionalism they require.

      Moreover, courts are now often swayed by a concept called “parental alienation syndrome” (PAS), coined by the late psychiatrist and psychoanalyst Dr. Richard A. Gardner in the 1980s to describe situations in which one parent is trying to turn the children against the parent during a divorce process. Dr. Gardner, a former professor of child psychiatry at the College of Physicians and Surgeons at Columbia University, testified in more than 400 child custody cases about its effect on children.

      PAS has been seized by the Fathers Rights movement as a way to defend husbands and other male partners from what they consider unjust accusations, and it has received support from other psychologists, who deny that it allows genuine child abuse to go unpunished. “If attorneys, child care evaluators, and judges were all doing their job, protective mothers wouldn’t have anything to fear,” says psychologist Amy J. Baker, author of Adult Children of Parental Alienation Syndrome: Breaking the Ties that Bind.

      The concept has made little documented headway in the professional and legal field, and the syndrome has been used very rarely in legal precedent. PAS is not included in the most recent American Psychiatric Association’s Diagnostic and Statistical Manual of Mental Disorders, although the association is currently weighing whether to include it in the 2013 issue of the manual.

      It may be ironic that efforts to give fathers more rights in custody cases have increased the odds against victimized mothers and children,

      “When the pendulum swung to shared custody somewhere in the midst of that (fathers) movement, the safety of children was compromised,” argues Helga Luest, founder of Witness Justice, a group that helps heal victims of violence.


      A Complex Web

      Tears fill Amy Leichtenberg’s voice as she recounts the horrible months before her two young boys, Duncan and Jack Connolly, ages 9 and 7, were killed by their father last March. “I felt like I did everything right, I sat there, I didn’t speak out of turn,” she said of her courtroom experience. After a 20-year abusive relationship with her ex-husband Michael Connolly, she finally gathered the strength to leave him. But he wouldn’t let her go. . Each time she moved her address, he showed up at her house. She got numerous orders of protection; he violated them repeatedly.

      Every six or seven weeks, the couple was back in court, following a motion filed by Connolly for one reason or another. Representing himself, he would badger Leichtenberg on the stand.

      Parental Alienation (PAS)

      An abuser- even a CONVICTED Abusers-CRIMES-Parental Alienation is used in Family Court to Give the children to the Abusers.

      I was ‘alienating” because HE beat the hell out of me- convicted in criminal court 8 times!! …and the Courts actually set it up in CO-PARENTING for him to CONTINUE for years to Assault.

      PAS is a Defense to Batterers. It is ONLY used with abusers and ONLY in CASES of Abuse to SILENCE the victims.

      It calls all allegations of abuse as false- Even when proven Abuse- and Convictions-

      It is used Against the victim and every Battered Mothers WILL and DO loose their Children because of the Parental Alienation Theories-

      I urge all who are middle line on this to please use common sense before more are killed and suffer irreparable harm as a result of the use of PAS.

      I am a PAS casualty – even with Criminal Convictions of Violence the response was- "we don’t want the daughter to KNOW what the Father did to the mother"

      As more and more abused women lose custody to batterers in family courts, they are wrongly embracing the very ideas that enabled their abusers to gain custody in the first place. False accusations of “parental alienation" are often used by batterers to gain custody and to defend against accusations of abuse.

      Some unfortunate women after years of enduring domestic violence have lost custody to the batterers who abused them. In these cases, batterers have made good on their threat to attack their ex-partner in the place she is the most vulnerable—by taking her children away from her. After separation, these batterers continue to wage their campaign of manipulation and abuse by attempting to convince involved children that their mothers never loved them. Looking for a way to describe their batterers’ behavior, some mothers have called what their batterer is doing "parental alienation syndrome."

      In reality, what these women are describing from their ex-partners is better termed Domestic Violence by Proxy (DV by Proxy), a term first used by Alina Patterson, author of Health and Healing. DV by Proxy refers to a pattern of behavior which is a parent with a history of using domestic violence or intimidation, uses a child as a substitute when he no longer has access to his former partner. Calling this behavior “parental alienation” is not strong enough to convey the criminal pattern of terroristic behaviors employed by batterers.

      When his victim leaves him, batterers often recognize that the most expedient way to continue to hurt his partner is to assert his legal rights to control her access to their children. By gaining control of the children, an abusive male now has a powerful tool which allows him to continue to stalk, harass and batter an ex-partner even when he has no direct access to her. Moreover, by emotionally torturing the child and severing the bond between children and their mother, he is able to hurt his intended victim — the mother — in a way she cannot resist.

      DV by Proxy includes tactics such as: threats of harm to children if they display a positive bond to the mother, destroying favored possessions given by the mother, and emotional torture (for example, telling the child the mother hates them, wanted an abortion, and is not coming to get them because they are unloved).

      DV by Proxy may also include coaching the child to make false allegations regarding their mother’s behavior and harming or punishing the child for not complying. DV by Proxy perpetrators may also create fraudulent documents to defraud the court in order to prevent the mother from gaining custody. Whether or not the child is biologically related to them is irrelevant to perpetrators of DV by Proxy. The perpetrator’s main motivation is to hurt his ex; whether or not his own child is harmed in the process is irrelevant to him.

      This is very different from "parental alienation syndrome" as described by the late Richard A. Gardner. Dr. Gardner described PAS as an internal process by which a child aligns themselves with a preferred parent to protect themselves from the divorce conflict. “PAS” is conceptualized as a psychological process of identification with a parent who, according to the theory, encourages this identification at the expense of the other parent.

      PAS inducing parents, according to Gardner, are often unconscious of what they are doing to encourage the identification. In contrast, perpetrators of DV by Proxy are very conscious of what they are doing. Controlling, coercive, illegal acts often done by abusive and controlling people, usually men, are not subtle, and do not encourage an identification with a parent. Criminal, fraudulent, coercive acts are visible and obvious. These behaviors encourage compliance by threats and fear. Behaviors involved in DV by Proxy are deliberate and often illegal. These behaviors include: battery, destruction of property, locking children in rooms to prevent them from calling parents, falsifying documents, along with other similar overt behaviors.

      The most dangerous aspect of Gardner’s PAS theory is that that the alienating parent’s behavior is theorized to be so subtle as to be unobservable. In other words, the behaviors that are supposed to cause the alienation are assumed to be happening without any proof that they have actually occured. As many women have discovered this makes a charge of "alienation" almost impossible to defend against.

      While Gardner’s theories regarding PAS have been shown to be overly general and have not been supported by careful research, behaviors seen in DV by Proxy can be readily observed. Behaviors involved in DV by Proxy are deliberate and planned; many are illegal, and if the child is given the freedom to talk, will be described in great detail by the child.

      If the child’s formerly favorable view of the victimized parent changes when exposed to tactics like this over time then it is more likely a form of "Stockholm Syndrome" or traumatic attachment to the abuser, rather than the alignment with one parent and negative reaction to the other that Gardner described as "alienation".

      Man kills wife, son

      Richard Lehman allegedly admitted to police Sunday that he shot and killed his wife and son in this Huntington Township home, where the three lived.

      A Huntington Township man was arrested Sunday for allegedly killing his wife and son in their home.

      Richard Lehman, 68, shot and killed his wife, 62-year-old Linda Lehman, and his 33-year-old son Travis shortly after midnight at their 6909 Old Harrisburg Road home, state police announced at press conference Sunday afternoon.

      Richard Lehman, according to police, called 911 to report the crime and admit his part in it.

      State police arrived within 15 minutes and told the desk officer who was still on the phone with Richard Lehman to instruct him to go outside, according to the affidavit of probable cause. He complied and when police asked if anyone else was inside he reportedly said “No, just two dead bodies,” and “kill me.”

      When police entered the home, they found Linda Lehman’s body with a gunshot wound to the head. Wagner said she was several feet from a phone.

      “It appears the wife observed the son being shot,” Wagner said.

      “The defendant related that he shot his wife because she was screaming and hollering and said that she was going to call the cops,” the affidavit reads.

      Travis Lehman was found in the kitchen, according to the affidavit, with a gunshot wound to the back of the head.

      Wagner said Richard Lehman appeared to be “coherent” and police do not believe drugs or alcohol were involved.

      Wagner would not discuss any possible motive for the murders or if Richard Lehman had any prior criminal record.

      Fire crews responded to the residence at 1 p.m., Saturday for what was originally described as a shed fire but classified by Adams County Control as a brush fire. Wagner would not comment as to whether the two incidences were at all related.

      A search for Richard Lehman on Pennsylvania’s Unified Judicial System’s web portal, which contains criminal docket sheets dating back to 2000, did not yield any results.

      He was charged with two counts of criminal homicide, according to Wagner. He is in Adams County Prison without bail and a preliminary hearing is tentatively scheduled for March 31.

      Autopsies on the bodies of Travis and Linda Lehman are scheduled for Tuesday morning at Lehigh Valley Hospital.

      Chad Whittington, who is formerly of Biglerville and currently lives in Ozark, Montana, said Sunday he was Travis’ “best friend” as a child but he has not had contact with the family in 15 years. He vividly remembers Richard Lehman, but not in a good way.

      “When we were kids he was very angry all the time, not much love in the house,” Whittington said. “I don’t recall him being very loving at all. I can remember him yelling at Mrs. Lehman to the point where we would be scared as kids.”

      However, his memories of Mrs. Lehman are much more pleasant.

      “Mrs. Lehman was an incredibly sweet lady,” he said.

      Wagner said this is the first double homicide in Adams County since he took office in 2003.

      State delegate candidate Frank Melvin Conaway Jr., who with 5,889 votes was the top vote-getter in the 40th District Democratic primary in September, doesn’t want this story published. His father, Baltimore City Clerk of the Circuit Court Frank M. Conaway Sr., doesn’t either. In separate interviews, both used the same, emphatic words: "You don’t have to write the story."

      Conaway Jr.’s longtime wife, Latesa Elaine Thomas, 44, has had a Baltimore County domestic-violence protective order against her husband for more than three years. The order, dated Aug. 25, 2003, states that Conaway Jr. "threatened to kill" Thomas, placing her "in fear of imminent serious bodily harm," and that "one year ago [he] pushed her face through back door window." Thomas also convinced the court that Conaway Jr., 43, was a threat to himself and others as a diagnosed sufferer of bipolar disorder who had stopped taking his prescribed medications, so the court ordered police escorts to deliver Conaway Jr. to two emergency hospital evaluations in the summer of 2003. Thomas is in the process of divorcing Conaway Jr.

      "We knew this day would come," Conaway Jr. says. It’s an unseasonably warm early-October afternoon, and he’s standing at the foot of the Battle Monument, in the middle of Calvert Street between the two circuit courthouses. "Somebody’s going to ask that question," he remarks, "and it’s none of your business." At the time, City Paper did not know what had happened to prompt the protection order.

      We know the Father’s Rights folks love Delegate Luiz R.S. Simmons also. Does he have many of them as clients (he does practice in "family law")? Is he working for their interests? This is from a website recently:
